Our client was arrested on a felony Fugitive From Justice charge based on an out-of-state warrant under Florida Statute § 941.02. Although the charge was ultimately not prosecuted, the State Attorney’s Office (SAO) refused to complete the FDLE application for expungement, claiming it was not the appropriate prosecuting authority due to the dismissal. This procedural denial posed a significant and often misunderstood barrier to record clearance. Our legal team investigated the case's administrative trail and filed a detailed objection to the SAO’s interpretation, arguing that non-prosecution did not negate their legal obligation to execute the application. After months of strategic engagement with the SAO and supporting documentation, the denial was reversed. We proceeded to file the expungement petition, which was granted in Hillsborough County 7 months after we were retained.
